Research in Motion is going through a bad phase. They are losing market share to Apple iOS and Google Android. Their Blackberry Playbook has failed to generate much excitement in the market. And their next mobile platform Blackberry 10 has suffered enough delays.
The company has received one good news though. They can continue to use BBM branding for their Messenger platform. RIM was sued by BBM Canada for using BBM branding for this service.
BBM Canada has owned the trademark for BBM for more than 60 years. Courts have ruled that RIM can continue to use BBM branding for their service as it has no similarity to what BBM Canada does.
We are pleased that the Federal Court of Canada sided with RIM and confirmed that RIM’s use of BBM does not infringe the trademark rights of BBM Canada as they had alleged.
